L’AGENZIA DELLE ENTRATE NON PUO’ VINCERE SOLO CON UNA PERIZIA “DI PARTE”


Secondo la Corte di Cassazione “È illegittima la rettifica del valore di compravendita di un terreno se fondata esclusivamente su una perizia redatta dall'Ufficio: si tratta, infatti, di una valutazione di parte che va raffrontata con eventuali altri elementi prodotti dal contribuente
Come spesso succede l’Agenzia delle Entrate ha ritenuto non vero il valore di compravendita, in questo caso, di un terreno edificabile basandosi su una stima redatta dall’Agenzia del Territorio. Conseguenza: maggiori imposte, sanzioni ed interessi.
Il contribuente, raggiunto dall’avviso di accertamento, aveva proposto ricorso in commissione tributaria, sia in primo che in secondo grado.
Dopo aver perso sia in primo che in secondo grado il contribuente aveva proposto ricorso anche in Cassazione lamentando, tra le varie, che il giudice di secondo grado aveva fondato la sua decisione solo sulla stima redatta dall’Agenzia delle Entrate.
La Corte di Cassazione, con la sentenza 10222/2016 ha ricordato che l’amministrazione finanziaria, avanti il giudice, è sullo stesso piano del contribuente e quindi la relazione di stima dell’immobile, che era stata redatta dall’Agenzia del Territorio e quindi da un organo interno alla stessa amministrazione, è una relazione tecnica di parte e non una perizia d’ufficio.
Il giudice di secondo grado, continua la Corte di Cassazione, può basare la sua decisione solo sulla perizia dell’Agenzia delle Entrate ma deve spiegare perché questa sia “più corretta e convincente” delle prove prodotte dal contribuente.
La “perizia” dell’Agenzia delle Entrate è solo una prova prodotta da una delle parti del processo tributario e non ha, di per sé, valore superiore alla documentazione prodotta dal contrbuente.

Speriamo che questa sentenza della Cassazione faccia terminare una lunga fila di avvisi di accertamento basati su stime, ad essere garbati, “discutibili”.

REVENUE AGENCY CAN NOT WIN WITH AN EXPERT REPORT ONLY


According to the Supreme Court ‘it is illegitimate the rectification of the purchase value of the land if it is based solely on an appraisal of the Office: it is, in fact, an assessment that must be compared with any other evidence produced by the taxpayer’
As often happens, the Revenue Agency has considered not true the sales value, in this case, of a building plot in the light of a written report of the Territory Agency. Consequence: higher taxes, penalties and interest.
The taxpayer, reached by the notice of assessment, has appealed to the Tax Commission.
After losing the first and the second instance, the taxpayer had also lodged an appeal in the Supreme Court asserting that, among other, the appellate court had based its decision only on the expert report of the Revenue Agency.
The Supreme Court, in its judgment 10222/2016, recalled that the tax authority, in front of the court, is on the same floor of the taxpayer and therefore the land report, which had been prepared by the Territory Agency and then from an internal organ of the Revenue Agency, it is a technical report and not an official appraisal.
The court of second instance, says the Supreme Court, may base its decision only on the Revenue Agency's expertise but it must explain why this is ‘more correct and convincing’ than the ones produced by the taxpayer.
The ‘expert report’ of the Revenue Agency is only a test produced by one of the parties of the tax trial, and It has not, in itself, a higher worth than the documentation produced by the taxpayer.

We hope that this judgment of the Supreme Court ends a long row of notices of assessment based on ‘questionable expert report’.

IL REVERSE CHARGE ALLARGA LA SUA ALA

Dal 2 maggio (2016) fino al 31 dicembre 2018 le vendite di:
·        Console da gioco
·        Tablet
·        Tablet PC e
·        Laptop (computer portatili)
saranno soggette all’inversione contabile (reverse charge) se effettuate verso i soggetti passivi IVA (in pratica i titolari di partita iva), anche se essi rivestono la qualifica di utilizzatori finali.
La fattura quindi dovrà essere emessa senza IVA con la dicitura reverse charge (o se si preferisce “inversione contabile”) e con l’indicazione dell’articolo di riferimento del reverse charge che in questo caso è l’articolo 17, comma 6, lettera c) del DPR 633/72. Per le altre tipologie di computer si dovrà, invece, continuare ad applicare il normale regime iva.
In base al decreto legislativo 24/2016 si estende quindi a questi beni il reverse charge che era già previsto per le «cessioni di dispositivi a circuito integrato» effettuata prima della loro installazione nei prodotti destinati ai consumatori finali.

Per completezza espositiva si aggiunge che i Tablet PC si differenziano dai PC (per i quali l’Unione Europea ha negato l’applicabilità del reverse charge con la decisione n. 2010/710/UE) per il fatto che sono dei Tablet (e quindi non dei computer) che però hanno dei sistemi operativi che li fanno funzionare come dei PC.

sales from May 2 (2016) until 31 December 2018 of:
• Game Consoles
• Tablet
• Tablet PC and
• Laptop
will be subject to the reverse charge if made to VAT number holders, even if they have the status of end-users.
The invoice will be issued without VAT under the reverse charge regime together with the indication of the reverse charge reference article which, in this case, is Article 17, paragraph 6, letter c) of DPR 633/72. For other types of computers it will, however, continue to apply the normal VAT regime.
Legislative Decree 24/2016 extends to these devices the reverse charge that was already provided for ‘the supply of integrated circuit devices’ made prior to their installation in products destined for consumers.
For the sake of completeness, I have to say that the Tablet PC are different from the PC (for which the European Union has denied the application of the reverse charge by Decision no. 2010/710/EU) on the grounds that It is a tablet (and therefore no computer) but It has operating system that make it work as a PC.
